New Details About The Two College Men Arrested For Gang Raping A Woman At A UCF Frat Party

She claims she woke up naked in a bedroom.

Two Orlando college students are behind bars after a woman claims they gang-raped her during a frat party. 

David Anthony Kirk, 20 and Jack Ryan Smith, 26, allegedly sexually assaulted the victim after a night of drinking at an Alpha Tau Omega party off the University of Central Florida campus. 

The victim told police that she drank alcohol on her way to the party — which was dubbed the "Meat Factory" by the organizers — and continued to drink when she got there. Most of her night was spent outside by a fire pit with Kirk and Smith.

She told officers that she was blacked out from drinking and can only remember "snapshots' of the evening. She did, however, recall waking up naked in a bedroom while Smith was raping her and Kirk was forcing her to perform oral sex. 

According to Orange County police, she overheard one of the men saying "my turn, my turn" and they switched positions while she cried. 

The next thing the victim said she remembers is sitting on the bathroom floor crying and texting her friends for help. She met them and went home and went to the hospital the following day. 

Both Kirk and Ryan were arrested on Saturday and charged with sexual battery. One of them is already speaking out about his innocence. 

“I am 100 percent innocent of these charges,” Kirk told reporters, “and I am confident the truth will prevail.”

In his court appearance on Wednesday, Kirk's attorney began to cast doubt on the victim's story. He suggested that she claimed rape only "after somebody walked in and she was embarrassed because she was caught in the act.”

The attorney questioned the woman's story and claimed she had given multiple accounts of the evening. He also said there is no physical evidence or any supporting witnesses. 

Kirk's attorney claimed that he has "no less than five witnesses" who can vouch for the student and his story. 

The other suspect, Smith, cried during his hearing and said: "I've never done anything wrong in my life." 

This is the second time in a year that UCF had to suspend the Alpha Tau Omega fraternity. Over the summer, a woman reported being raped during another party. The organization said it supports the victim in this case and that the party wasn't tied to Alpha Tau Omega. 

Organizers said the frat's only involvement was that an undergraduate member encouraged the victim to file a police report. Kirk was expelled by the chapter this past January and Smith was never a pledge or member.
