In addition, YourTango will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve YourTango from any and all liability arising from your use of any third-party website.
  3. Accordingly, we encourage you to be aware when you leave the YourTango Website and to read the terms and conditions and privacy policy of each other website that you visit.

    4. You agree not to use the Website, including any articles and the YourTango Embeddable Player for any commercial use, without the prior written authorization of YourTango. Prohibited commercial uses include any of the following actions taken without YourTango's express approval:

  5. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the Website in a manner that sends more request messages to the YourTango servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, YourTango grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of and solely to the extent necessary for creating publicly available searchable indices of the materials, but not caches or archives of such materials. 5. Your Use of Content on the Site

In addition to the general restrictions above, the following restrictions and conditions apply specifically to your use of content on the YourTango Website.

  1. The content on the YourTango Website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to YourTango, subject to copyright and other intellectual property rights under the law. Content on the Website is provided to you AS IS for your information and personal use only and may not be downloaded, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. YourTango reserves all rights not expressly granted in and to the Website and the Content.
  2. You may access User Submissions solely:
    1. for your information and personal use;
    2. as intended through the normal functionality of the YourTango Service; and
    3. for Streaming. "Streaming" means a contemporaneous digital transmission of an audiovisual work via the Internet from the YourTango Service to a user's device in such a manner that the data is intended for real-time viewing and not intended to be copied, stored, permanently downloaded, or redistributed by the user. Accessing User Videos for any purpose or in any manner other than Streaming is expressly prohibited. User Videos are made available "as is."
  3. User Comments are made available to you for your information and personal use solely as intended through the normal functionality of the YourTango Service. User Comments are made available "as is", and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, downloaded, or otherwise exploited in any manner not intended by the normal functionality of the YourTango Service or otherwise as prohibited under this Agreement.
  4. You may access YourTango Content, User Submissions and other content only as permitted under this Agreement. YourTango reserves all rights not expressly granted in and to the YourTango Content and the YourTango Service.
  5. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the Website for any commercial purposes.
  6. You agree not to circumvent, disable or otherwise interfere with security-related features of the YourTango Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the YourTango Website or the Content therein.
  7. You understand that when using the YourTango Website, you will be exposed to User Submissions from a variety of sources, and that YourTango is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against YourTango with respect thereto, and agree to indemnify and hold YourTango, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

6. Your User Submissions and Conduct

  1. As a YourTango account holder you may submit text (“User Blogs”) or video content ("User Videos") and textual content ("User Comments"). User Blogs, User Videos and User Comments are collectively referred to as "User Submissions." You understand that whether or not such User Submissions are published, YourTango does not guarantee any confidentiality with respect to any User Submissions.
  2. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: you own or have the necessary licenses, rights, consents, and permissions to use and authorize YourTango to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service.
  3. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to YourTango, you hereby grant YourTango a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the YourTango Website and YourTango's (and its successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the YourTango Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the YourTango Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The above licenses granted by you in User Videos terminate within a commercially reasonable time after you remove or delete your User Videos from the YourTango Service. You understand and agree, however, that YourTango may retain, but not display, distribute, or perform, server copies of User Submissions that have been removed or deleted. The above licenses granted by you in User Comments are perpetual and irrevocable.
  4. In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant YourTango all of the license rights granted herein.
  5. You further agree that you will not, in connection with User Submissions, submit material that is contrary to the YourTango Community Guidelines, found below, which guidelines, may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.
  6. YourTango does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and YourTango expressly disclaims any and all liability in connection with User Submissions. YourTango does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and YourTango will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. YourTango reserves the right to remove Content and User Submissions without prior notice.

7. Account Termination Policy

  1. YourTango will terminate a User's access to its Website if, under appropriate circumstances, they are determined to be a repeat infringer.
  2. YourTango reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. YourTango may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

8. Digital Millennium Copyright Act

  1. If you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
    1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
    2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
    3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
    4. Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;
    5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
    6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. YourTango's designated Copyright Agent to receive notifications of claimed infringement is: Publisher, Tango Media, 101 W. 79th Street, Unit 2G, New York, NY, 10024. Email: editors@yourtango.com, fax: 646-864-6553. You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.
  3. Counter-Notice. If you believe that your User Submission that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your User Submission, you may send a counter-notice containing the following information to the Copyright Agent:
    1. Your physical or electronic signature;
    2. Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
    3. A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
    4. Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in San Francisco, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
  4. If a counter-notice is received by the Copyright Agent, YourTango may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at YourTango's sole discretion.

These tracking tools will collect information on what parts of our websites interest you - in other words, your behavior or browsing history. We also work with outside partners who help us gather this information. These partners help us both on our websites as well as outside websites. How We Share Your Information

Personally, Identifiable Information

Except as described in this Privacy Policy, Company will not rent or sell your personally identifiable information to others.

Company may share your personally identifiable information with our affiliates and third parties solely for the purpose of providing services to you. We may store personal information in locations outside the direct control of Company (for instance, on servers or databases co-located with hosting providers).

As we develop our business, we may buy or sell assets or business offerings. Customer, email and visitor information is generally one of the transferred business assets in these types of transactions. We may also transfer such information in the course of corporate divestitures, mergers or dissolution.

Except as otherwise described in this privacy statement, Company will not disclose personal information to any third-party unless required to do so by law, regulation or subpoena or if we believe that such action is necessary to: (a) conform to the law, comply with legal process served on us or our affiliates or investigate, prevent or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies or to protect the security or integrity of our Website; and (c) to exercise or protect the rights, property or personal safety of Company, our users or others. Please note we may not provide notice prior to disclosure in such cases.

Non-Personally Identifiable Information

We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to help them and us understand the usage patterns for certain Company services.

Company allows other companies, called third-party ad servers or ad networks, to serve advertisements on the Website. These third-party ad servers or ad networks use technology to send, directly to your browser, the advertisements and links that appear on the Website. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content.

Company does not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, please note that if an advertiser asks Company to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad-server may conclude that you fit the description of the audience they are trying to reach.

You should consult the respective privacy policies of these third-party ad servers or ad networks. The Company privacy policy does not apply to, and we cannot control the activities of such advertisers.

How We Protect Your Information

We maintain appropriate administrative, technical, and physical safeguards designed to protect the personal information you provide against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. That said, it is not possible to guarantee the security of information transmitted online, and you assume some risk with regard to the security of information you provide through any website, including this Site. If you have a data security inquiry, you may contact us by emailing security@yourtango.com.

Company uses commercially reasonable physical, managerial and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to Company and you do so at your own risk. Once we receive your transmission of information, Company makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered or destroyed by breach of any of our physical, technical or managerial safeguards.

To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from Company, at all times.

Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, Company will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy or as otherwise required by applicable law.

Your Choices About Your Personal Information

You may, of course, decline to submit personally identifiable information to Company, in which case Company may not be able to provide certain services to you.

Children's Privacy

We care about the safety of children and take the protection of children’s privacy very seriously. Company does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number or email address. No one under age 13 is allowed to provide any personal information to Company. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us at webmaster@yourtango.com.

Third Party Advertisements and Technologies:

We use third-party advertising companies to serve advertisements when you visit the Website as is explained in detail in the Website's Terms of Use. In the course of advertisements being served to you, a unique third-party cookie or other advertising technology may be placed on your browser. This advertising technology uses information derived from your visits to the Website to target advertising within this Website. This information is used for many purposes; for example, it helps us try to ensure that you do not see the same advertisements over and over again. We also use this information to help select and display targeted advertisements that we believe may be of interest to you (sometimes called “online behavioral advertising” or “interest-based advertising” or “OBA”). We also use web beacons, provided by third-party advertising companies, to help manage and optimize our online advertising. Web beacons enable us to recognize a browser's cookie when a browser visits this Website, to learn which banner ads bring users to our Website and to deliver more relevant advertising.

In addition, our advertisers or other third parties may use other third-party advertising technology to target advertising on the Website and other websites. We do not control the data collection and use practices of these other third parties. You should read the privacy notices of the websites you visit in order to determine what companies may be collecting information on those websites.

YourTango Community Guidelines

 Respect the YourTango Community

We're not asking for the kind of respect reserved for nuns, the elderly, and brain surgeons. We mean don't abuse the site. Every cool new community feature on YourTango involves a certain level of trust. We trust you to be responsible, and millions of users respect that trust. Please be one of them.

Don't Cross the Line

 Here are some common-sense rules that will help you steer clear of trouble:

  • YourTango is not for pornography or sexually explicit content. If this describes your content or video, even if it's a content that belongs to you or a video of yourself, don't post it on YourTango. Also, be advised that we work closely with law enforcement and we report child exploitation. Please read our Safety Tips and stay safe on YourTango.
  • Don't post text or videos showing bad stuff dealing with animal abuse, drug abuse, under-age drinking and smoking, or bomb making.
  • Graphic or gratuitous violence is not allowed. If your content deals with or video shows someone being physically hurt, attacked, or humiliated, don't post it.
  • YourTango is not a shock site. Don't post gross-out text or videos about accidents, dead bodies or similar things intended to shock or disgust.
  • Respect copyright. Only upload content and videos that you wrote or made or that you are authorized to use. This means don't upload text or videos you didn't write or make or use content that someone else owns the copyright to, such as music tracks, snippets of copyrighted articles or programs, or videos made by other users, without necessary authorizations. Read our Copyright Tips for more information.
  • We encourage free speech and defend everyone's right to express unpopular points of view. But we don't permit hate speech (speech which attacks or demeans a group based on race or ethnic origin, religion, disability, gender, age, veteran status, and sexual orientation/gender identity).
  • Things like predatory behavior, stalking, threats, harassment, intimidation, invading privacy, revealing other people’s personal information, and inciting others to commit violent acts or to violate the Terms of Use are taken very seriously. Anyone caught doing these things may be permanently banned from YourTango.
  • Everyone hates spam. Don’t create misleading descriptions, tags, titles or thumbnails in order to increase views. It's not okay to post large amounts of untargeted, unwanted or repetitive content, including comments and private messages.

 Please take these rules seriously and take them to heart. Don't try to look for loopholes or try to lawyer your way around the guidelines—just understand them and try to respect the spirit in which they were created.

YourTango is for the Community

 Remember that this is your community! Each and every user of YourTango makes the site what it is, so don't be afraid to dig in and get involved!

  • Have fun with the site. There's a lot to do here, and lots of folks posting amazing stuff—one of them might be you!
  • Let folks know what you think. Feedback's part of the experience, and when done with respect, can be a great way to make friends, share stories, and make your time on YourTango richer. So, leave comments on articles and videos---there's a lot going on and a lot of ways to participate.
  • You may not like everything you see. Some of the content here may offend you—if you find that it violates our Terms of Use, then click the button that says "Flag" under the comment, post or video you're watching to submit it for review by YourTango staff. If it doesn't, then consider just clicking on something else—why waste time watching videos you don't like?

 Hope that you enjoy the site—The YourTango Team

Community Guideline Tips

Here are some helpful examples and tips:

Sex and Nudity

Most nudity is not allowed, particularly if it is in a sexual context. Generally, if text or comments are intended to be sexually provocative, it is less likely to be acceptable for YourTango. There are exceptions for some educational, documentary and scientific content, but only if that is the sole purpose of the post or video and it is not gratuitously graphic.

Hate Speech

"Hate speech" refers to content that promotes hatred against members of a protected group. For instance, racist or sexist content may be considered hate speech. Sometimes there is a fine line between what is and what is not considered hate speech. For instance, it is generally okay to criticize a nation, but not okay to make insulting generalizations about people of a particular nationality.

Shocking and Disgusting

The world is a dangerous place. Sometimes people do get hurt and it’s inevitable that these events may be documented on YourTango. However, it’s not okay to post violent or gory content that’s primarily intended to be shocking, sensational or disrespectful. If a video is particularly graphic or disturbing, it should be balanced with additional context and information. For instance, including a clip from a slaughter house in a video on factory farming may be appropriate. However, stringing together unrelated and gruesome clips of animals being slaughtered in a video may be considered gratuitous if its purpose is to shock rather than illustrate.

Dangerous Illegal Acts

While it might not seem fair to say you can’t show something because of what viewers theoretically might do in response, we draw the line at content that’s intended to incite violence or encourage dangerous, illegal activities that have an inherent risk of serious physical harm or death. This means not posting videos on things like instructional bomb making, ninja assassin training, sniper attacks, videos that train terrorists, or tips on illegal street racing. Any depictions like these should be educational or documentary and shouldn’t be designed to help or encourage others to imitate them.

Children

Videos involving children (anyone under the age of 18) are particularly sensitive. Videos containing children should never be sexually suggestive or violent. Please be cautious when posting something involving a child. If you’re sharing a private moment or home movie, consider making it a private video so that only your family and friends can see it.

Copyright

When you create something original, you own the copyright for it. Likewise, when other people create content, they may have a copyright to it. As a creative community, it’s essential that everyone on YourTango respect the copyrights of others. If you’re not sure if something will violate someone’s copyright, the safest thing to do is to create something completely original, with images and audio you’ve created. If it’s all yours, you never have to worry about copyright—you own it. If you’ve recorded something from a DVD, videotaped your TV screen, or downloaded a video online, don’t post it unless you have permission.
