The couple had two children together: a son, Hermes Gustaf Rutherford Giersch, on Oct. 18, 2006, and a daughter, Helena Grace Rutherford Giersch, on June 8, 2009. However, a still-pregnant Rutherford filed for divorce from Giersch on Dec. 30, 2008. After a heated custody battle, it was determined that they would have joint custody of their children through April 2010 but, in September 2009, Rutherford obtained a temporary restraining order against Giersch.
